CITY OF McALESTER NOTICE OF HEARING ON PROPOSED ZONING ORDINANCE AMENDMENT NOTICE IS HEREBY GIVEN to all property owners and residents of the City of McAlester, that a Public Hearing will be held before the McAlester Planning Commission on Tuesday, October 18, 2016 at 6:30 p.m. concerning an ordinance amending the McAlester City Code, Division 3. Zoning Districts and District Regulations, Subdivision II. Specific Districts, Section 62-213 Wade Watts Corridor Development to modify Sections 62-213(c) General Provisions and Descriptions; 62-213(d) Uses Permitted; and 62-213(e) Uses Permitted After Review as follows: a. Sections 62-213(c) General provisions and descriptions. The WW district and its regulations may be applied to property located within one block north of Wade Watts Avenue and one block south of Wade Watts Avenue between Strong Boulevard and George Nigh Expressway (Highway 69) except that lots south of the east/west alley in Blocks 454, 455, and 456 are excluded. More particularly, this area as described in the following platted blocks of the original plat of the city: • All of Blocks 412, 413, 414, 415, 416, 417, 418, 419, 457, 458, 459, 460 and 461. • Lots north of the east/west alley in Blocks 454, 455, and 456. The WW district and its regulations may be applied to the described properties even though, and at the same time, the property is under the regulations of the R-1B (Single-Family Residential) district, and C-2 (Neighborhood Convenience Commercial) district, and C-5 (Highway Commercial and Commercial Recreation) district. b. Sections 62-213 (d) Uses permitted. (1) R-1B Single-Family Residential when the underlying zoning is R-1B; (2) C-2 Neighborhood Convenience Commercial when the underlying zoning is C-2; (3) C-5 Highway Commercial and Commercial Recreation when the underlying zoning is C-5. c. Sections 62-213 (e) Uses permitted after review. (1) a. Barber and/or beauty shop; b. Medical and/or dental clinics; c. Pharmacy; d. Professional offices; e. Public uses; f. Financial institute [institution]; g. Florist/gift shops; h. Grocery store; i. Motor fuel sales only (no service station); j. Variety store; k. Pet shop (not including veterinarian clinics); l. Restaurant; m. Self-service and/or full-service laundry; n. Car wash; o. Funeral facilities; p. Carpet and floor covering sales, retail. q. Any other small to medium sized commercial establishment consistent with the list above that provides shopping and service outlets for the convenience of the neighboring residential areas. (2) Accessory buildings or uses customarily incidental to the allowed uses. (3) Any public building or use. (4) Churches, provided they have major street frontage as shown on the major street plan and meets requirement for off-street parking. Any person wishing to appear in support or opposition to the proposed Zoning Ordinance Regulation Amendment may do so in the Council Chambers, Municipal Building, located at 28 E. Washington Avenue, McAlester, Oklahoma, at the above date and time. FURTHER NOTICE IS HEREBY GIVEN to all property owners and residents of the City of McAlester, that if the Tuesday, October 18, 2016 Planning Commission meeting is canceled due to any reason such as but not limited to adverse weather conditions, lack of a quorum, etc.; the October 18, 2016 Planning Commission Meeting will be adjourned to be continued to a new specific date and time as announced at the October 18, 2016 Meeting to conduct the above Public Hearing or the Public Hearing will automatically be rescheduled and placed on the agenda for the Tuesday, November 15, 2016 McAlester Planning Commission meeting at 6:30 p.m. /s/Cora Middleton, City Clerk Date: September 29, 2016.
