ORDINANCE NO. 31 AN ORDINANCE CREATING THE OFFICE OF TOWN CLERK-TREASURER AND PRESCRIBING THE DUTIES THEREOF; TRANSFERRING DUTIES AND ABOLISHING THE OFFICES OF THE TOWN CLERK, TOWN DEPUTY CLERK, AND TOWN TREASURER; AND PROVIDING EFFECTIVE DATES. WHEREAS, the members of the Board of Trustees of the Town of Carlton Landing, Oklahoma feel it in the best interest of the Town of Carlton Landing and the Governing Body of the Town of Carlton Landing to consolidate the positions of Town Clerk and Town Treasurer into one position named Town Clerk-Treasurer WHEREAS, the power to combine these positions and create the position of Clerk-Treasurer is granted in the Oklahoma Statue 11 O.S. § 12-106 BE IT ORDAINED BY THE TOWN BOARD OF TRUSTEES OF THE TOWN OF CARLTON LANDING, OKLAHOMA: SECTION 1. There is hereby created the office of Town Clerk-Treasurer who shall be appointed by the Board of Trustees of the Town of Carlton Landing, Oklahoma to serve as an appointee from 12:01 A.M. on June 1, 2016 until the next General Municipal Election to be held in April, 2017. Thereafter the Town Clerk-Treasurer shall be elected for a term of four (4) years beginning with that municipal election in April of 2017. SECTION 2. All powers and duties assigned to the Town Clerk by statute, ordinance, or by the Board of Trustees on or before the effective date of this Ordinance shall be transferred to and held and exercised by the Town Clerk-Treasurer when the appointment of Town Clerk-Treasurer is made by the Board of Trustees, Carlton Landing, Oklahoma, and thereafter as provided by laws regulating Municipal Elections. SECTION 3. All powers and duties assigned to the Town Treasurer by statute, ordinance, or by the Board of Trustees on or before the effective date of this Ordinance shall be transferred to and held and exercised by the Town Clerk-Treasurer when the appointment of Town Clerk-Treasurer is made by the Board of Trustees, Carlton Landing, Oklahoma, and thereafter as provided by laws regulating Municipal Elections. SECTION 4. The offices of town Clerk and Town Deputy Clerk are hereby abolished at the time this Ordinance becomes effective. SECTION 5. From and after the effective dates provided herein, all references to the Town Clerk or the Town Treasurer in the Oklahoma Statutes shall mean the Town Clerk-Treasurer SECTION 6. EMERGENCY SECTION WHEREAS, in the judgment of the Town Board of Trustees, it is necessary for the preservation of the peace, health, welfare, and safety of the Town of Carlton Landing, Oklahoma, and of the inhabitants thereof, that the provisions of this ordinance be put into full force and effect immediately, an emergency is hereby declared to exist by reason whereof this ordinance shall take effect and be in full force from and after its passage as provided by law.
