(Published in the McAlester News-Capital on April 28th&May 5th, 2016.) NOTICE OF SHERIFF'S SALE NOTICE IS HEREBY GIVEN that on the 16th day of June, 2016, at 10:00 o'clock a.m., in Front Lobby of the Pittsburg County Courthouse, 115 E. Carl Albert Parkway, McAlester, Oklahoma, the Sheriff of Pittsburg County will offer for sale and sell, for cash, at public auction, to the highest and best bidder subject to unpaid ad Valorem Taxes, all the following described real estate: Lot 17 in FALCON COVE NO. 2, according to the subdivision Plat recorded in Folio 95A in Pittsburg County, Oklahoma, together with all rights, easements, appurtenances, royalties, mineral rights, oil and gas rights, crops, timber, all diversion payments or third party payments made to crop producers, and all existing and future improvements, structures, fixtures, and replacements that may now, or at any time in the future, be part of the real estate described above, including any and all water wells, water, ditches, reservoirs, reservoir sites and dams located on the real estate and all riparian and water rights associated with the real estate however established, said property having been duly appraised at $129,500.00. Sale will be made pursuant to a Special Execution and Order of Sale issued in accordance with the Final Journal Entry of Judgment and Decree of Foreclosure entered in the District Court of Pittsburg County, State of Oklahoma, in Case No. CJ-2015-00267, Mabrey Bank, Plaintiff, vs. Dale James Warren, et al., Defendant,to satisfy a Judgment and lien in favor of Mabrey Bank in the sum of principal plus accrued interest through April 27, 2015 of $140,068.84 plus accrued interest through August 14, 2015 of $$1,867.59 plus late charges of $25.00 plus additional interest at the rate of $23.34481 per day from August 14, 2015 until paid plus a reasonable attorney’s fee of $2,000.00 plus $365.00 for the cost of obtaining an abstract on the Mortgaged Property plus the costs of this action accrued and accruing, including poundage upon any amounts disbursed by the Court Clerk herein.
